Family Neonatal Intensive Care Leave Act (NICU Leave)
The Family Neonatal Intensive Care Leave Act (NICU Leave) entitles eligible employees with up to 20 days of unpaid, job-protected leave while a child of an employee is a patient in a neonatal intensive care unit (NICU).
Length of leave under the Act is based on employer size:
- Employers with fewer than 16 employees are not covered.
- For employers with 16-50 employees: 10 days;
- For employers of 51+ employees: 20 days;
This leave is in addition to any leave an employee may be eligible for under the federal Family and Medical Leave Act of 1993, 29 U.S.C. 2601 et seq.
